1. Parties & Contractual Framework
These Terms and Conditions (“Terms”) constitute a legally binding agreement between TutorPulse Ltd (“Company”, “We”, “Us”, “Our”) and the purchasing entity, which may be an individual school, a Multi-Academy Trust (MAT), a Local Authority, or an individual subscriber (“Subscriber”, “Institution”, “You”). By accessing or using the TutorPulse platform, you agree to be bound by these Terms.
2. Service Provision & Multi-Tenant Boundaries
The Service: TutorPulse provides a multi-tenant, cloud-based classroom management, pastoral check-in, and interactive utility dashboard (“The App”).
Licence Scope: We grant You a non-exclusive, non-transferable, revocable licence to access the service for the number of active classroom forms allocated to your subscription tier (e.g., Standard Tier cap of 3 forms; School-Wide Tier cap as defined in your specific service schedule).
Account Security: Institutions must provision accounts via their designated school_admin. The institution is entirely responsible for safeguarding login credentials on shared classroom hardware. Because the app utilizes explicit Session Persistence (SESSION), subscribers must ensure browser tabs are closed at the end of each working day to enforce local device data clearance.
3. Intellectual Property
Ownership: TutorPulse retains all rights, titles, and interests in the platform architecture, software, source code, design systems (including Neo-Brutalist CSS tokens, branding, and imagery), and the globally aggregated content pools generated by our background automated processing pipelines.
Subscriber Content: The Institution retains ownership over its entered student rosters, customised school-specific schedules, and localised notice bulletins. You grant TutorPulse a localised licence to host, cache, and display this data strictly to provide the dashboard features to your authenticated tenant domain.
4. Subscription Fees, Term, and Termination
Payment & Renewals: Solo Teacher subscriptions are billed monthly in advance and Whole School subscriptions are billed annually in advance through Stripe Checkout. Both renew automatically unless cancelled before the renewal date. No invoice or purchase-order payment workflow is currently offered.
Cancellation: The purchasing Solo subscriber or School Admin may cancel renewal through the Stripe Customer Portal at any time. Cancellation takes effect at the end of the current paid billing period, and access normally continues until that date. Teacher accounts created by a School Admin do not own the school subscription and cannot cancel it.
Refunds: Initial Solo Teacher and Whole School purchases may be cancelled for a full refund within 14 calendar days of purchase. After that period, payments are normally non-refundable, including for unused time. This does not limit rights that cannot lawfully be excluded, including remedies where the service is faulty, misdescribed or not supplied with reasonable care and skill. Data after cancellation: Cancellation does not immediately delete customer data. Access and data handling after the paid period ends will follow the applicable retention policy, school instructions and privacy documentation.
5. Limitation of Liability & Service Availability
Availability: While we aim for 99.9% uptime, we are not liable for classroom disruptions caused by local school Wi-Fi throttling, network dropouts, or external public domain API failures (e.g., LibriVox metadata faults).
Global Maintenance: TutorPulse reserves the right to toggle “Global Maintenance Mode” to push critical updates or service worker (sw.js) cache invalidations. Advance notification will be broadcast via the Super Admin system wherever practical.
